Site rules

1.1 The Owner is not the organiser, participant, seller or buyer in any transaction. The Site is an intermediary that helps sellers and buyers get in touch with each other.

1.2 The Owner places ads in the appropriate section, which helps users find parts easily.

1.3 The Owner does not own any of the products listed on the Site and has no additional information about their actual condition.

1.4 The quality, safety, legality and accuracy of description of the parts listed in ads are not controlled by the managing company.

1.5 The information posted on the Site serves to help users sell their products and get in touch with other users.

1.6 Any natural person or legal entity posts personal information on the Site voluntarily and in their own interests.

1.7 By posting information on the Site, the user agrees that the information will be public and visible to any user.

1.8 In view of clause 1.7, the user bears all risks associated with the disclosure of this information.

1.9 Information posted on the Site has no legal force; before any financial transaction the user must verify that the information is correct.

1.10 The user must read these terms and conditions. The company may unilaterally amend and supplement the terms and conditions without prior notice to users. Visiting or using the website automatically means that the user accepts these terms and conditions.

2.1 The user may not post an ad whose content contradicts the legislation of Georgia in force.

2.2 To post an ad for a part on the Site, you must register and accept the Nawilebi.ge terms of use.

2.3 Any natural person or legal entity may post ads on the Site, except natural persons under 18.

2.4 Following the Site instructions, the user must provide complete information about the part for sale, photos of it and the terms of the deal. Photos uploaded to an ad must show only the part for sale or its surroundings. It is forbidden to upload images other than photos of the part for sale or its surroundings (among other things, an uploaded file must not be an agency or company logo, a photo of other property, or a photo carrying the author's website, phone number, offered services or any other unrelated information).

2.5 By posting an ad, the user confirms that they have the right to sell the part listed in the ad or have obtained the relevant consent to offer it for sale.

2.6 Posting up to 3 ads per month on the website is free; the price and conditions for each further ad depend on the user type.

2.7 The user may post ads about buying and selling parts.

2.8 An ad must not:

2.8.1 be false or inaccurate, or mislead users.

2.8.2 serve fraud, deception or abuse of trust.

2.8.3 contain information about buying or selling stolen or counterfeit products.

2.8.4 concern the tangible or intangible property of a third party, or violate the personal rights of a third party.

2.8.5 contain information that damages the dignity or business reputation of a third party.

2.8.6 contain discrimination against religious, ethnic or other minorities.

2.8.7 contain threats against anyone.

2.8.8 call for criminal acts.

2.8.9 support or provoke terrorist or extremist acts.

2.8.10 contain pornographic content.

2.8.11 contain advertising for property, goods, services or a company other than the subject of the ad (among other things, it is forbidden to put phone numbers of paid phone information services in an ad or in a user or agency profile).

2.8.12 violate the legislation of Georgia in force in any other way.

2.9 The user may not conclude that a transaction is legal from the fact that the product is listed on the Site.

2.10 If a user profile and/or ad is blocked or other restrictive measures are taken on the Site, the paid service on the ad is cancelled and the amount paid for it is not refunded to the user. Paid services are also not transferred from one ad to another.

2.11 If the desired goal is achieved as a result of posting an ad on the Site, or if the ad is deleted and/or the user profile is closed, the amount paid for paid services is not refunded to the user and unused paid services are not transferred to another ad.

3.1 The Owner is not a party to any agreement and is not responsible for the actions of any user. All negotiations take place directly between users.

3.2 The Owner is not responsible for the accuracy of the information posted on the Site.

3.4 The Owner cannot guarantee that the details given on the Site by the person posting an ad match their real details.

3.5 Any ad posted on the Site in breach of clause 2.7 will be deleted, and the user name used to post it will be blocked for a period from 1 week up to permanently, depending on the content of the ad.

3.6 If clause 2.7 is breached two or more times, the managing company may block the user's phone number and IP address.

3.7 The Owner may advertise a posted ad in a way different from the one chosen by the user.

3.8 The Owner may stop publishing any ad at any time.

3.9 The Owner is not responsible for the loss of or damage to information posted on the Site, or for lost messages.

3.10 The Owner does not guarantee that the Site will work continuously and without interruption.

3.11 If several user accounts are registered in order to post a large number of ads on the Site, the Owner may block the user's IP address.

3.12 If the agreement is breached, the managing company may block the user's IP address.

3.14 The Owner may change this agreement without any special notice. Changes to the agreement will be published in the "Site rules" section.

3.15 The Owner may send the user advertising messages, offers and promotions to the phone number they gave on the Site.

4.1 The user may not give their user name and password to a third party

4.2 If there is any suspicion that their personal details have been disclosed, the user must change them immediately.

4.3 The user may not post ads on the Site other than those described in clause 2.7.

4.4 The user must immediately inform the managing company, using the "Report an incorrect ad" button, about ads that in any way violate the website rules or contradict the legislation of Georgia in force.

4.5 The user may not advertise anything in an ad (other than the subject of the ad) or include a link to another website.

4.6 The user must act in accordance with the legislation of Georgia in force and the Site rules, and is liable under Georgian law for their actions on the Site.

4.7 If the user has any claim against or misunderstanding with another user, they address the claim directly to that user, independently of the managing company. The user releases the managing company (and any of its employees) from all claims, including compensation for losses, reimbursement of costs and any other expenses related to an agreement made through the Site.

4.8 The user may use the Site without any warranty and in accordance with the legislation of Georgia in force.

4.9 The user takes full responsibility for the information they post on the Site; the Site gives them a way to provide information to other users.

4.10 The user declares and confirms that the products or services they offer fully comply with the Product Safety and Free Movement Code, the Law of Georgia on Advertising and other legal norms in force in this area.

4.11 The user also declares and confirms that the information and advertising material provided about the products or services they post, and/or its creation, do not infringe the copyright of third parties.

4.12 Accordingly, the user confirms that on request they will immediately withdraw the relevant ad and/or will have no claim against the Site for removing such an ad if a discrepancy is found between the guarantees given by the user and the ads registered on the Site.

4.13 The user also agrees to fully compensate any damage caused to the Site and any fines imposed on it as a result of the inaccuracy of these declarations.

4.14 The user may apply to the company in writing and request a refund or cash-out of the positive balance on their personal account. The refund will be made within 30 (thirty) calendar days of the request, and the Owner may withhold 10% (ten percent) of the refunded amount as a penalty.

4.15 The user should be aware that if money paid into their personal balance has not been used within the last 24 (twenty-four) months since it was paid in, the Owner may reset the balance to zero, and the amount written off will be treated as a penalty.

4.16 By accepting this agreement, the user confirms that the Owner may notify them of promotions and offers or send advertising messages to the phone number they provided.

5.1 The user must provide real details: contact number, email address, gender, location and year of birth.

5.2 It is forbidden to register with another person's details.

5.3 The user name and password must be an active email address owned by the user; it may contain Latin letters (A-Z), digits (0-9) and symbols.

5.4 It is forbidden to use any offensive phrase in the user name.

5.5 If the money paid in by the user has not been used within 2 years of the last top-up, the balance is reset to zero.

By entering the Site, the user confirms and agrees that its content, including ads, photos and other information posted by users, is the property of the Site. Unauthorised use and/or duplication of this material in any form, or moving it to a space owned by a third party, constitutes use of the commercial assets of the Site, which is strictly forbidden without the public consent of this Site and/or the written permission of IE "Marine Moseshvili".

Grounds:

• The website Nawilebi.ge belongs to Binebi.ge LLC (identification code: 412761006). The Owner has the exclusive right to use the content posted on the Site, including but not limited to photos and any information posted by users, which under the legislation in force also gives it the exclusive right to prohibit any unauthorised use and distribution of materials posted on the Site;
• In case of unauthorised use of the content posted on the Site, including but not limited to photos and any information posted by users, the Owner reserves the right to claim compensation for damage in accordance with the "Website terms of use";

Infringement of copyright, related rights and the rights of a database maker is a punishable offence and entails criminal liability (see Article 189 of the Criminal Code of Georgia)

• receive information about the data processed about you;
• request that incorrect, inaccurate and/or incomplete data be corrected, updated and/or completed;

request that data processing be stopped, or the data deleted or destroyed, if:

you withdraw the consent that is the only basis for processing the data; to withdraw consent, you can contact us at the email address given in the "Contact" section of the Site.

• the data are no longer needed for the purpose for which they were processed;
• the data are being processed unlawfully.

request that the data be blocked, if:

• the authenticity or accuracy of the data is disputed;
• the processing is unlawful, but you object to deletion and ask for the data to be blocked instead;
• the data are no longer needed for the purpose of processing, but you need them for legal proceedings;
• a request to stop processing, delete or destroy the data is being considered;
• withdraw at any time the consent by which you allowed us to process your data. In that case we will stop the processing unless there is another legal basis for it;
• file a complaint about the processing, including with the State Inspector's Service or a court;

Restriction of your rights:

Your rights may be restricted if this is expressly provided for by law, or if exercising them could endanger important financial or economic interests of the country, the exercise of the functions and powers of supervisory bodies, or the protection of state, commercial, professional and other secrets provided for by law.

The website services are not designed or intended for persons under 18, or for persons who have not reached the age of legal consent for using the services in any jurisdiction ("legal age"). If you are not of legal age, you may not download or use the services or provide us with personal information.

We reserve the right to access and check any personal information received from you. If we learn that information was shared by a user who has not reached the age of majority, we may disregard it. If you have reason to believe that information was shared with us by a minor, please let us know.
